QLYQ TERMS OF USE

These Terms of Use (“Terms”) govern your access to and use of the QlyQ platform, including https://qlyq.net, mobile applications, APIs, creator tools, and related services (collectively, the “Service”).

The Service is operated by QlyQ.Net, a company incorporated under the laws of Malaysia (“QlyQ,” “we,” “us,” or “our”).

By accessing or using the Service, you agree to be legally bound by these Terms.

1. Eligibility

You must be at least 13 years old, or the minimum legal age in your jurisdiction.

If you are under the age of majority in your jurisdiction, you represent that you have parental or guardian consent.

You may not use the Service if:

• You have previously been suspended from QlyQ

4. User Content and License Grant

You retain ownership of content you upload (“User Content”).

By submitting User Content, you grant QlyQ a:

Worldwide, perpetual (subject to deletion), non-exclusive, royalty-free, transferable, sublicensable license to use, host, reproduce, modify, distribute, publicly display, publicly perform, create derivative works, and otherwise exploit such content for the purposes of operating, improving, promoting, advertising, and monetizing the Service across all media formats now known or later developed.

This includes:

• Content promotion
• Cross-border distribution
• Algorithmic ranking
• Platform advertising
• Syndication via partners

You represent that you have all necessary rights to grant this license.

5. Platform Intellectual Property

All rights in:

• QlyQ branding
• Software
• Algorithms
• Platform architecture
• Data structures

remain the exclusive property of QlyQ.

You may not:

• Reverse engineer
• Scrape data
• Train AI models on platform content
• Circumvent technical safeguards

6. Artificial Intelligence and Automated Systems

6.1 Automation And AI Use

QlyQ may use automated systems, including artificial intelligence, to:

• Moderate content
• Rank content
• Detect fraud
• Personalize recommendations
• Analyze engagement

You acknowledge that algorithmic systems may affect visibility and monetization outcomes.

We do not guarantee reach, engagement, or revenue.

6.2 Algorithmic Systems

QlyQ uses automated systems and algorithms to rank, recommend, distribute, or limit content visibility. The operation of these systems is proprietary and confidential. QlyQ is not obligated to disclose the specific functioning of these systems.

6.3 Prohibited Data Collection and AI Training

You may not use automated systems, bots, scrapers, or similar technologies to access, collect, or extract data from the Service for the purpose of building datasets, training machine learning or artificial intelligence systems, or developing competing services without the express written permission of QlyQ.

7. Acceptable Use

7.1 Prohibited Content

You agree not to upload content that:

• Violates laws
• Infringes intellectual property
• Promotes violence or exploitation
• Is sexually exploitative
• Harasses or threatens others
• Manipulates platform metrics
• Contains malicious code

7.2 Artificial Engagement Prohibition

Users may not artificially manipulate platform metrics including views, likes, shares, comments, follows, or engagement signals through bots, automation, coordinated networks, or paid engagement services.

We reserve the right to remove content at our discretion.

7.3 Security Restrictions

You may not attempt to probe, scan, test the vulnerability of, or breach any security or authentication measures of the Service or its underlying infrastructure.

8. Copyright and DMCA Compliance

QlyQ respects intellectual property rights.

If you believe your copyrighted work has been infringed, you may submit a takedown notice under our Copyright Policy.

We may:

• Remove allegedly infringing material
• Terminate repeat infringers
• Forward counter-notices where appropriate

9. Monetization and Payments

QlyQ may provide monetization tools, including:

• Advertising revenue programs
• Creator funds
• Digital gifting
• Brand partnerships
• Affiliate integrations

Eligibility and payment calculations are determined at QlyQ’s sole discretion.

QlyQ:

• Does not guarantee income
• May modify revenue formulas
• May withhold payments for fraud
• May suspend monetization privileges

Users are responsible for taxes and reporting obligations.

10. Third-Party Services and App Stores

The Service may be accessed via third-party platforms, including mobile app stores.

Your use of the Service through third-party providers may also be subject to their terms.

QlyQ is not responsible for third-party services.

11. Suspension and Termination of Service And/Or Account

11.1 Access Restrictions

We may suspend or terminate access:

• For Terms violations
• For legal compliance
• For suspected fraud
• To protect platform integrity

We may remove or retain content as required by law.

11.2 Service Availability

QlyQ does not guarantee that the Service will be uninterrupted, secure, or error-free. Maintenance, updates, outages, or technical failures may affect availability at any time.

12. Legal Protections

12.1 Disclaimers

The Service is provided “AS IS” and “AS AVAILABLE.”

To the maximum extent permitted by law, QlyQ disclaims all warranties, including:

• Merchantability
• Fitness for a particular purpose
• Non-infringement

We do not guarantee uninterrupted service.

12.2 Limitation of Liability

To the maximum extent permitted by law:

QlyQ shall not be liable for indirect, incidental, consequential, or punitive damages.

Total aggregate liability shall not exceed:

• The amount paid by you to QlyQ in the preceding 12 months, or
• USD 100, whichever is greater.

12.3. Indemnification

You agree to indemnify and hold harmless QlyQ and its affiliates from claims arising from:

• Your User Content
• Your misuse of the Service
• Your violation of these Terms
• Your violation of third-party rights

12.4 Legal Compliance

QlyQ may disclose information, remove content, or restrict accounts where required to comply with applicable laws, government requests, court orders, or regulatory obligations.

13. Arbitration and Class Action Waiver (Global Standard)

Except where prohibited by law:

Any dispute arising out of or relating to these Terms shall be resolved through binding arbitration under the rules of a recognized international arbitration body.

You agree:

• To resolve disputes individually
• To waive participation in class actions
• That arbitration shall be conducted in English

Nothing prevents either party from seeking injunctive relief for intellectual property violations.

14. Governing Law

These Terms shall be governed by the laws of Malaysia, without regard to conflict of law principles.

For users in jurisdictions where arbitration is restricted, local mandatory consumer protections apply.

15. Export and Sanctions Compliance

You may not use the Service if you are located in a country subject to international trade restrictions or if you are on a government sanctions list.

16. International Users

You are responsible for compliance with local laws.

We make no representation that the Service is appropriate in all regions.
