QLYQ CREATOR TERMS

These Creator Terms (“Creator Terms”) govern your participation as a content creator, publisher, or professional contributor on QlyQ.

These Creator Terms supplement the QlyQ Terms of Service and apply in addition to the Creator Monetization Terms (Ads + Digital Gifting Hybrid). In the event of conflict:

    1. These Creator Terms govern creator rights and obligations.
    2. Creator Monetization Terms govern revenue and payments.
    3. Terms of Service govern general platform use.

By publishing content as a creator, you agree to these terms.

  1. Creator Status

By participating as a creator, you acknowledge that:

    • You act as an independent content publisher.
    • You are not an employee, agent, or partner of QlyQ.
    • You are solely responsible for your content, audience interactions, and business activities.

Nothing in these Terms creates an employment, partnership, or agency relationship.

  1. Eligibility & Verification

To participate as a creator, you must:

    • Maintain an active account in good standing.
    • Comply with QlyQ Community Guidelines.
    • Provide accurate identity information.
    • Complete verification or KYC procedures if requested.
    • Be legally eligible to enter binding agreements in your jurisdiction.

QlyQ may suspend or revoke creator status at its discretion.

  1. Content Ownership & License to QlyQ

3.1 Ownership

You retain ownership of your original content.

3.2 License Grant

By uploading or publishing content, you grant QlyQ a:

      • Worldwide
      • Non-exclusive
      • Royalty-free
      • Transferable and sublicensable
      • Perpetual (for hosted content)

license to:

      • Host
      • Reproduce
      • Distribute
      • Publicly display
      • Publicly perform
      • Adapt for technical purposes
      • Promote and market QlyQ

This license enables QlyQ to operate, improve, and promote the platform.

If content is deleted, the license ends except where:

    • Content has been shared or embedded by others
    • Retention is required for legal or compliance purposes
  1. Creator Responsibilities

You agree:

    • You own or have all necessary rights to your content.
    • Your content does not infringe intellectual property.
    • Your content complies with applicable laws.
    • You will not publish unlawful, deceptive, or harmful content.
    • You will not mislead viewers regarding sponsorships or endorsements.

You are responsible for all required regulatory disclosures in your jurisdiction.

  1. AI Content

Creators are responsible for ensuring AI-generated or AI-assisted content complies with QlyQ’s AI & Synthetic Media Policy. Creators bear full legal responsibility for outputs generated by AI tools.

  1. Sponsorship & Brand Collaborations

Creators may engage in:

    • Brand partnerships
    • Sponsored content
    • Affiliate marketing
    • Product placements

You must:

    • Clearly disclose paid promotions.
    • Comply with applicable advertising regulations (e.g., FTC, EU, ASEAN rules).
    • Not falsely represent QlyQ endorsement.

QlyQ may restrict sponsorship categories for safety, legal, or brand reasons.

  1. Monetization Eligibility

Monetization eligibility is governed by the Creator Monetization Terms.

QlyQ:

    • Does not guarantee revenue.
    • May limit monetization by geography or content type.
    • May change monetization models at any time.

Participation in monetization programs is a privilege, not a right.

  1. Algorithm & Distribution

QlyQ uses automated systems to determine:

    • Content ranking
    • Visibility
    • Recommendations
    • Monetization eligibility

QlyQ does not guarantee:

    • Views
    • Followers
    • Engagement
    • Revenue

Algorithmic decisions are final.

  1. Brand Safety & Content Classification

QlyQ may:

    • Classify content for advertiser suitability.
    • Restrict monetization of sensitive content.
    • Apply age restrictions.
    • Remove or limit distribution of policy-violating material.

Content classification decisions are made at QlyQ’s discretion.

  1. Prohibited Conduct

Creators may not:

    • Artificially inflate views, engagement, or gifting.
    • Use bots or automated systems.
    • Engage in coordinated manipulation.
    • Promote illegal goods or services.
    • Evade enforcement actions.

Violations may result in:

    • Demonetization
    • Suspension
    • Termination
    • Withholding of earnings
  1. Platform Promotion Rights

QlyQ may:

    • Feature your content in marketing materials.
    • Promote your creator profile.
    • Include your content in curated campaigns.

No additional compensation is owed unless separately agreed.

  1. Data & Analytics

QlyQ may provide creators with:

    • Performance metrics
    • Engagement data
    • Revenue dashboards

Such data:

    • May be estimated
    • May be subject to fraud filtering
    • May be adjusted

QlyQ does not guarantee data accuracy.

  1. Taxes & Legal Compliance

Creators are solely responsible for:

    • Income tax reporting
    • VAT / GST obligations
    • Business licensing
    • Regulatory compliance

QlyQ may request tax documentation before issuing payments.

  1. Suspension & Termination

QlyQ may suspend or terminate creator accounts for:

    • Policy violations
    • Fraudulent activity
    • Legal risk
    • Reputational risk
    • Regulatory compliance

Termination does not guarantee payment of withheld earnings.

  1. Confidentiality

Creators must not disclose:

    • Confidential monetization terms
    • Platform algorithms
    • Internal policies
    • Non-public product features
  1. Limitation of Liability

To the maximum extent permitted by law:

QlyQ is not liable for:

    • Loss of revenue
    • Algorithm changes
    • Audience decline
    • Third-party actions

Total liability shall not exceed amounts paid to you in the preceding six months.

  1. Modifications

QlyQ may update these Terms.

Continued use of the platform constitutes acceptance.

  1. Governing Law

These Terms are governed by the laws of Malaysia.

Disputes shall be resolved via binding arbitration in English, unless prohibited by law.
